Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Owner Page (“we”, “us”, “our”) governing your access to and use of the Owner Page website and application (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Owner Page is a tool that helps property owners track their properties, work records, tasks, vendors, and related documents. We may add, change, or remove features at any time, and we may suspend or discontinue the Service in whole or in part without liability to you.

You must provide accurate information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorized use. You must be at least 16 years old, or the age of majority in your jurisdiction, to use the Service.

You agree to use the Service only for lawful purposes and in compliance with all applicable laws, rules, and regulations of your jurisdiction. You are solely responsible for the content you upload, store, or share through the Service.

You agree not to: upload, store, or transmit any content that is illegal, infringing, or that you do not have the right to use; violate the rights of any third party, including intellectual property and privacy rights; upload malware or attempt to disrupt, compromise, or gain unauthorized access to the Service or its infrastructure; use the Service to harass, abuse, or harm others; or use the Service in any way that could damage, disable, or impair it or interfere with others’ use of it.

We reserve the right, but are not obligated, to remove content or suspend accounts that we believe violate these Terms or applicable law.

You retain ownership of the content you submit to the Service. You grant us a limited license to host, store, process, and display that content solely as necessary to operate and provide the Service to you.

You are responsible for maintaining your own backups of important content. While we take reasonable measures to protect your data, you should not rely on the Service as your sole copy of any critical records or documents.

Certain features require a paid subscription. Fees, billing cycles, and plan limits are described at the time of purchase. Payments are processed by our third-party payment processor, and you authorize us and that processor to charge your selected payment method.

Unless otherwise stated or required by law, fees are non-refundable. We may change our prices on a going-forward basis; we will provide notice of material changes, and continued use after a price change constitutes acceptance. You may cancel at any time, and cancellation takes effect at the end of the current billing period.

The Service relies on third-party providers for functions such as authentication, payment processing, email delivery, and hosting. Your use of the Service may also be subject to those providers’ terms. We are not responsible for the acts, omissions, or availability of third-party services.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY DATA WILL BE ACCURATE OR PRESERVED. ANY INFORMATION PROVIDED THROUGH THE SERVICE IS FOR GENERAL ORGANIZATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE LEGAL, FINANCIAL, TAX, OR PROFESSIONAL ADVICE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL OWNER PAGE OR ITS OWNERS, OPERATORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

You agree to indemnify, defend, and hold harmless Owner Page and its owners and operators from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your content, your use of the Service, or your violation of these Terms or any applicable law or third-party right.

You may stop using the Service and close your account at any time. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or applicable law, or to protect the Service or other users. Upon termination, your right to use the Service ends, and we may delete your content in accordance with our Privacy Policy. Provisions that by their nature should survive termination will survive.

We may update these Terms from time to time. When we make material changes, we will update the date below and, where appropriate, provide notice. Your continued use of the Service after an update means you accept the revised Terms.

These Terms are governed by the laws of the State of Louisiana, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Louisiana, except where prohibited by applicable law.
